Hillsdale, ND St., Montreal Among Top 200 Non-FBS Schools The ranks of Historically Black Colleges, Junior Colleges, Canadian Football, and lower NCAA divisions field a number of football teams that would likely win some games if they were able to play FBS schools. A list of the top-200 non-FBS schools below includes conservative bastion Hillsdale, which took a stand against racism in the 1950s by refusing a bowl bid based on discrimination.

North Dakota State's continued dominance of FBS schools indicates they would probably win about 78% of their games at the FBS-level, good enough to be ranked 24th in the country and a clear No. 1 among non-FBS schools. ESPN Game Day chose Fargo for their broadcast in recognition of the non-FBS powerhouse.

The numbers by each school indicate their rank among the top 200 non-FBS schools, where they would rank in a top 100 of FBS schools, as well as the likely average score and winning percentage if they played an all-FBS schedule.

Yale (108th) will try to pull an upset against Army, and Eastern Illinois (16) is actually a slight favorite again Ohio, in the only two games scheduled by FBS schools this week against lower divisions. FBS schools no longer play any lower level except for FCS schools, due to being penalized in NCAA rankings, but many schools from these ranks would likely be able to win some of those games.

Hillsdale was invited to the 1956 Tangerine Bowl, now called the Citrus Bowl, but refused to play because the Bowl officials would not allow their black players to participate. A separate posts details the indicators on why the top-10 teams would likely do well against an FBS opponent.

More than 500 other non-FBS schools did not make this Top 200.

Scott & Scott, LLP Partners, Robert J. Scott and Julie-Machal-Fulks, will be co-presenters on a live Strafford CLE Webinar discussing best practices for drafting and negotiating IT master services agreements on October 7th, 1:00-2:30 PM ET.

Southlake, Texas (PRWEB) September 25, 2014

“Drafting IT Master Services Agreements: Guidance for Purchaser and Vendor Counsel” CLE webinar will provide business counsel with a roadmap for drafting and negotiating information technology (IT) master services agreements (MSAs). The panel will cover key provisions that should be included in the agreements and strategies for avoiding common negotiation pitfalls and resolving contract disputes.

The use of MSAs brings efficiency and consistency to the process of contracting for technology services. Careless drafting of MSAs or focusing solely on price during contract negotiations can be a grave mistake that leads to lost money and time, disputes, and potential litigation.

“We will discuss best practices for drafting and negotiating IT MSAs including key clauses that should be in the contracts, strategies for avoiding common drafting pitfalls and resolving contract disputes,” said Robert J. Scott, Managing Partner, of intellectual property and technology law firm, Scott & Scott, LLP.

The panel will review these and other key questions:· What are the key questions counsel to purchasers and vendors must first consider before undertaking the negotiation and drafting of an IT MSA?
· What contract terms are most frequently included in MSAs?
· What are the most commonly disputed issues during contract negotiations and what are effective approaches to resolve them?

Following the presentation, attendees will have an opportunity to get answers to specific questions during an interactive Q&A session.

Starfish Retention Solutions Announces 2014 Starfish 360 Award Winners

Innovative Institutions Recognized for Effective Student Success and Retention Programs

(PRWEB) September 25, 2014

Starfish Retention Solutions, Inc., a leading student success company, is pleased to recognize Northeast Wisconsin Technical College, the University of Texas at El Paso, and Youngstown State University as the winners of the 2014 Starfish 360 Awards Program™. The awards program is designed to recognize institutions in the Starfish client community that have helped students in particularly innovative and impactful ways.

The distinguished panel of independent judges included Julie Noble, Ed.D., principal research associate in the Research Division at ACT, Inc.; Janene Panfil, senior vice president for retention solutions at Noel-Levitz; and Randy Swing, Ph.D., executive director of the Association for Institutional Research (AIR).

Starfish 360 Award Winners:

Northeast Wisconsin Technical College: Since 2010, the “Dream: Learn It, Live It” program at NWTC has centered on two ideas: first, that every student can succeed, and second, that every employee can contribute to student retention and completion. NWTC credits the Starfish® platform with catalyzing positive culture change and supporting that change with straightforward tools. NWTC’s data shows that overall gateway course pass rates jumped 7.6 percent after just one year of using Starfish flags and Kudos.

The University of Texas at El Paso: UTEP’s approach to student success includes a “deep dive” into one often-overlooked feature in the Starfish platform: ZoomIn. Since 2012, the ZoomIn feaure has given UTEP’s instructors — especially those overseeing large, introductory course sections — a user-friendly and effective tool for engaging students. UTEP’s institutional research department reports that students in course sections where the ZoomIn feature was used had significantly higher pass rates than their control counterparts, and that the students previously identified as high-risk benefited the most.

Youngstown State University: YSU sees the Starfish platform as a hub for connecting all the components and programs that inform the university’s student success initiatives. Thanks to enthusiastic and wide-spread adoption of the Starfish platform by both faculty and student success personnel, YSU’s course completion rates have been steadily rising from term to term. When the Starfish platform was implemented in 2012, YSU students were completing 81.1 percent of the courses they attempted. By spring 2014, that number had increased to 85.2 percent.

The judges also selected three Starfish 360 Rising Stars. This distinction is given to institutions that have launched the Starfish platform within the past year and have already demonstrated measurable outcomes. The Rising Stars for 2014 are Philadelphia University, Ramapo College of New Jersey, and Viterbo University.

“Each year, the Starfish 360 Awards Program gives us the opportunity to shine a spotlight on a few of the many success stories within our client community,” said David Yaskin, CEO of Starfish Retention Solutions. “We are proud that the Starfish platform is helping institutions achieve these impressive student outcomes, and we hope the winners will inspire other institutions as they inspire us! Congratulations to the Award Winners and Rising Stars!”

Award Winners and Rising Star recipients each receive cash prizes to support the ongoing development of their student success programs. More information about the Starfish 360 Awards Program can be found on the company’s Web site.

The $1 billion Texas State-based financial institution will use FMSI’s software to reduce staff downtime and improve efficiencies across its ten retail branch locations.

Alpharetta, GA (PRWEB) September 25, 2014

FMSI, a leading workforce optimization solution provider for banks and credit unions, announced today WestStar Bank has adopted FMSI’s Omnix Staff Scheduler™, Omnix Interactive Dashboard™ and Omnix Performance Analytics™solutions. The $1 billion Texas State-based financial institution will use FMSI’s software to reduce staff downtime and improve efficiencies across its ten retail branch locations.

“Our previous employee scheduling model, at times, resulted in unnecessary amounts of downtime for our employees, caused by staffing our branches for unexpected spikes in traffic,” says Linda Hernandez, 1st VP Teller Operations at WestStar Bank. “We knew there were significant efficiency gains to be made by better aligning our staff with fluctuations in traffic, but struggled to find an internal solution that would also avoid service disruptions. FMSI’s solution gave us the confidence we needed to move forward with a more progressive staffing approach, by supporting us with ongoing reporting highlighting exactly how our staffing levels should look like.”

FMSI’s Omnix Suite of Products™ addresses the concerns of today’s financial institutions: keeping down expenses while improving service levels and sales in the branches. Through the collection and then preparation of front-line staff interaction data, FMSI’s system quickly empowers management teams with easy-to-read and actionable business intelligence.

“In our previous efforts to improve our staffing efficiencies, we experienced some resistance from some of our branch employees,” adds Hernandez. “Now that we have concrete third-party information from FMSI, our staff will be much more receptive to improving our workforce optimization—a process that will be much easier with FMSI’s automated Omnix Staff Scheduler™ application.”

“Maintaining teller staffing at the ideal level to ensure customer satisfaction can sometimes be a very bank specific decision,” says W. Michael Scott, President/CEO of FMSI. "Without accurate information, most financial institutions are not equipped to make a proper evaluation. With more than 25 years of experience helping banks and credit unions improve the productivity of their staff, our unique solutions for measuring and forecasting transaction volumes regularly reveal areas for better service, more sales and increased productivity."

Maria Wormington, founder of law firm Wormington & Bollinger, has pledged her support for the “I Will Prevent Elder Abuse” movement. Wormington & Bollinger is a McKinney, Texas firm with a longstanding focus on medical malpractice, and Maria Wormington’s pledge represents the firm’s ongoing commitment to fighting against cases of elder abuse and nursing home negligence.

Dallas, Texas (PRWEB) September 25, 2014

The “I Will Prevent Elder Abuse” initiative was developed by the Maricopa Elder Abuse Prevention Alliance (MEAPA®) and the Area Agency on Aging Region One. The program aims to shine a spotlight on the important social issues surrounding elder abuse by encouraging individuals and businesses to personally commit to fighting against abuse of the elderly.

As the American population continues to age, abuse of seniors has become a growing problem. In 2013, almost 9,000 cases of vulnerable adults were reported to Adult Protective Services in Arizona alone. However, it is estimated that more than 90% of elder abuse cases go unreported. The “I Will Prevent…” movement aims to raise awareness of this issue and create improved living conditions for the senior population.

Speaking about her recent pledge, Maria Wormington commented, “Our firm sees tragic cases of elder abuse all too frequently. Many institutions that we trust such as assisted living facilities and nursing homes are not equipped or staffed to effectively and compassionately treat our aging loved ones. We are dedicated to fighting for the rights of elderly victims and their families. Only by working together and standing strong against those who would take advantage of the vulnerable can we ensure that our loved ones can enjoy their golden years with comfort and dignity.”

To learn more about Maria Wormington and Wormington & Bollinger, visit the firm’s website at http://www.wormingtonlegal.com/. Wormington & Bollinger is proud to represent victims of elder abuse across the state of Texas including the cities of Dallas, Arlington, Fort Worth, and Plano. NES Financial Launches China Website to Provide Chinese Investors and Advisors with Valuable Insight into EB-5

Website translated and adapted for Chinese audience

San Jose, CA (PRWEB) September 25, 2014

NES Financial announced that it has deployed an EB-5 website specifically for Chinese investors and their advisors. With the popularity of the EB-5 program continuing to grow, the information offered on the site will help educate parties on EB-5 and provide details on escrow and fund administration best practices to help investors and their advisors as they consider investing in a project.

The EB-5 visa program, created in 1990, encourages investment into projects that stimulate U.S. job growth, while providing an opportunity for foreign nationals to become lawful permanent residents. An applicant’s investment is frequently held in escrow prior to investment in a New Commercial Enterprise. While many countries around the world have citizens who participate in the program, the majority of investors hail from China.

The EB-5 process is lengthy and can involve many complexities along the way. For new participants, it may seem difficult to navigate through all of the requirements. Investors in particular have a lot at stake, so it is crucial for them to know what to expect. NES Financial’s website not only provides information on the benefits of the company’s leading suite of EB-5 Solutions, but also gives background on the program and highlights aspects investors and their advisors should consider in order to make the most informed decisions.

Foreign investors should be concerned with security, transparency, and compliance. While conducting their due diligence on projects, Chinese investors, their agents, and advisors will be looking for projects that can offer these elements. The website will feature resources such as best practices and solution sheets to help investors understand some of the key questions to ask EB-5 issuers before making an investment decision.

“It is critical for these Chinese investors and their agents to be as well-educated and informed about the program as possible,” said Dandan Zou, President and CEO of Texas Investment Regional Center and a leader in the Austin Chinese community. “Investors desire secure and transparent solutions but may not be aware of how to get them. NES Financial helps fulfill this need with an additional website. The features of their EB-5 solutions give investors that much needed access and transparency into the EB-5 process and help set a much higher quality standard throughout the entire EB-5 industry.”

“Interest in EB-5 from overseas, especially China, continues to grow,” said Reid Thomas, NES Financial Executive Vice President. “Each of NES Financial’s EB-5 Solutions was designed to provide increased security, transparency, and compliance to all stakeholders. EB-5 issuers that implement them tend to see a higher success rate when marketing to investors.”

The Mesothelioma Compensation Center says, “A recent update on EstatePlanning.com gives a great insight into all that is required when taking care of an estate, which is why we are taking the time this week to share it in the hopes of shedding light on the subject. The attorneys we suggest are experts in their field and can provide much needed clarification for victims and families going through the arduous process of a mesothelioma diagnosis, as well as sit down with the family and create a step-by-step order of what needs to take place, when it comes to compensation." http://MesotheliomaCompensationCenter.Com

(PRWEB) September 25, 2014

The Mesothelioma Compensation Center says, "We cannot emphasize enough how incredibly vital it is for a family to have access to the best possible mesothelioma attorneys in the nation. The subject of estate planning is something we have discussed in the past, but this new information has renewed our interest in reaching out to victims and educating them on how important it is to align the work of the family CPA or estate planners in helping to protect the victim's settlement.

"The attorneys we suggest will know what must be done. We want to emphasize estate planning and/or taxes need to be discussed." For more information a diagnosed victim of mesothelioma, or their family members can call the Mesothelioma Compensation Center anytime at 866-714-6466.

From Estate Planning.Com in July of 2014: "Unfortunately, a lot of people haven’t participated in any meaningful estate planning. Most will readily admit it is something they need to do, but they keep putting it off. Here are some of the more common reasons why we procrastinate about estate planning—and some information that just might get you moving.

“It’s expensive. Granted, a lot of people don’t have extra money lying around these days. But not doing anything can end up costing your loved ones much more than it would cost you to plan now. If you own assets in your name and you become incapacitated due to illness or injury, you (your assets and your care) will likely be placed in a court guardianship. This is not free."

Before a diagnosed victim of mesothelioma, or their family members hire an attorney to advance a mesothelioma compensation settlement, please call the Mesothelioma Compensation Center at 866-714-6466 before hiring any attorney.
