Texas poised to execute 500th prisoner as lawyers fight to save her life

Kimberly McCarthy, 52, to face lethal injection next week for 1997 murder but lawyers say judicial process was fatally flawed

Lawyers in Texas are fighting to save the life of a female prisoner scheduled to become the 500th person to be executed by the state since the death penalty was reinstated in America in 1976.

Barring a last-minute stay, Kimberly McCarthy, 52, will face lethal injection next Wednesday for the 1997 murder of her neighbour. Should the execution be carried out, she would be the 500th person put to death by Texas, a state that has shown more enthusiasm in modern times for capital punishment than any other.

The next seven days will be the culmination of an emotional and legal rollercoaster for McCarthy. This is her third appointment with the death chamber in the space of five months.

"She is a very spiritual person. She believes what's meant to be is meant to be, and it's all in God's hands," said Maurie Levin, McCarthy's legal counsel since January.

Now Levin has filed a new motion to stay execution with the Texas court of criminal appeals. The filing argues that McCarthy has suffered from two fundamental flaws that persistently crop up in death penalty cases.

"As it turns out, Kimberly McCarthy is an African American woman scheduled to be the 500th person to be executed in Texas. Her case raises two of the most typical issues in the administration of the death penalty: race discrimination and the quality of counsel," Levin told the Guardian.

At the heart of the habeus application is evidence compiled by Levin that the jury at McCarthy's original trial in 2002 was essentially rigged through blatant racial discrimination. The case was racially charged from the start as it involved an African American defendant – McCarthy, pictured – and a white victim, her 71-year-old neighbour Dorothy Booth.

Dallas County, the area around the city of Dallas, where the trial was held, is 69% white and 23% black. Yet among the 13 men and women selected to form McCarthy's jury, only one was black.

Out of an initial pool of 64 prospective jurors, only four non-whites made it through to the final selection. Of those four, three were ejected from the actual jury through peremptory strikes by prosecution lawyers.

McCarthy's application for a stay of execution alleges that prosecutors consciously set out to distort the racial composition of the jury as part of a culture of discrimination that stretches back to the days of southern segregation. The filing cites the case in 1938 where the African American president of a historically black college was thrown headfirst down the Dallas County courthouse steps after he objected to being excused from jury service.

In 1963, a Texas training manual instructed prosecutors not to "take Jews, negroes, dagos, Mexicans, or a member of any minority race on a jury, no matter how rich or how well educated". A similar manual published in 1986 carried the memorable advice that it was "not advisable to select potential jurors with multiple gold chains around their necks or those who appear to be 'free thinkers'."

The habeus application traces such discrimination through to the present day. In 2005, three years after McCarthy was convicted and put on death row by an overwhelmingly white jury, an investigation by the Dallas Morning News found that prosecutors were still excluding eligible blacks from juries at more than twice the rate of eligible whites.

The filing argues that McCarthy was tried within the context of this history and culture of racial discrimination. Two of the prosecutors from the district attorney's office who led the capital case against her were trained within such an environment, the habeus application states.

Levin has gone further. In a separate filing, she has asked the presiding judge of the Texas court of criminal appeals Sharon Keller, and another judge sitting on the court Micheal Keasler, to recuse themselves from the McCarthy case on the grounds that they also served as assistant district attorneys in the same Dallas County prosecutors' office where the culture of discriminatory jury selection allegedly existed.

In addition to the claim of racially-skewed jury selection, Levin also argues that McCarthy should be spared execution because she received poor legal counsel after she was sent to death row. A recent US supreme court ruling, Trevino V Thaler, requires Texas courts to consider appeals from prisoners facing execution where they claim to have received inadequate legal representation after they were convicted.

Levin points out that neither McCarthy's original defence lawyer at trial, nor her subsequent counsel after she was sent to death row, made any attempt to challenge the racially distorted composition of the jury. "The evidence of discrimination in the selection of the jury was there to be had, yet her counsel did very, very little to examine her case for constitutional errors." Texas Coalition for Affordable Power (TCAP) has announced the addition of five new members, bringing its roster to 169: City of Manvel, City of Bangs, City of Venus, City of Aubrey, and Acton Municipal Utility District. Former Texas Prosecutor Kaycee Jones Admits To Receiving Texts From Judge During Trial In a letter to the Texas State Bar, ex-Assistant District Attorney Kaycee Jones confessed that she received text messages from Judge Elizabeth Coker during a criminal trial in 2012. The texts from Coker, who was on the bench for the trial, were intended to help the prosecution’s case.

"I deeply regret that I acted in this manner,” Jones, who is now a District Court Judge in Polk County, Texas, said. “It was wrong and I knew better."

Jones’ confession and a photo copy of Coker's text message, which details a line of witness questioning that would aid prosecutors, were outlined in a letter Jones sent to the Texas Bar Association's disciplinary counsel, which is investigating the incident.

Part of the letter signed by Jones includes the following:

"On August 8, 2012, I did receive a text message from Judge Coker that suggested a line of questioning in an Injury to a Child trial over which she was presiding and telling me to tell the trial prosecutor. I was not the trial prosecutor and had nothing to do with the investigation or prosecution of the case, but I was present in the courtroom for portions of the trial as an observer. When I received the text, I hand wrote the text verbatim and asked our investigator to deliver it to the prosecutor who was trying the case.”

The defendant was found not guilty, but citizens, professors, and the Texas Criminal Defense Lawyers Association have raised questions about the issue and whether it has occurred before or since the 2012 incident.

In addition to the complaint against Jones, filed  with the State Bar Association by a local attorney, Polk County District Court Judge Elizabeth Coker's actions are being reviewed by the State Commission on Judicial Conduct.

Texas Republicans Tried To Silence This Abortion Rights Advocate. Instead, This Happened

Sarah Slamen's passionate testimony against an anti-abortion bill in front of the Texas state Senate was cut off earlier this week, when the Republican presiding over the proceedings ordered her to be removed from the room. If the goal was to silence her, it has clearly failed.

Since delivering part of her late-Monday takedown of legislation that would restrict abortions after 20 weeks and close most abortion clinics in Texas, Slamen has been on a tear, giving interviews and making sure the message she had intended to give gets delivered. On Wednesday night, she appeared on MSNBC's "The Last Word," where host Lawrence O'Donnell gave her a chance to finish the testimony that was unceremoniously abbreviated.

"What I would say to all of the Republicans on the Senate Health & Human Services Committee is that I understand why you are so careless with our health care," Slamen said. "You see, all of your constituency lies east of I-35, where the five clinics remaining after that bill gets passed will be. None of your constituents are west of I-35, so I guess their lives and families just don't matter to you."

Slamen also explained that she had finally reached her "breaking point" after watching hours of testimony from anti-abortion witnesses who had either provided medically unsound testimony, or suggested that pro-choice women were "murderers, killers, insinuating that we're promiscuous." The real turn came when one witness came to the stand to explain the difficult decision of aborting her pregnancy after finding out that her unborn child had a rare form of spina bifida. An anti-choice person next to her interjected and said that she'd known children with spina bifida who had been adopted. The interruption was not called out as a breach of Senate decorum.

The decision to have her dragged out of the room was indicative of a larger issue of Republicans not wanting to hear the facts, Slamen told O'Donnell. She said the demographics of the witnesses were a function of a number of socioeconomic factors.

"I'm privileged as a white woman from a middle-class background to be able to have attended all of those hearings," she said. "Women with two and three jobs, the 20 percent of women who might be living in the rural communities of Texas who can't get to the capitol, caregivers, they can't get to the hearings and stand up for their rights, and it's obvious that all the Republicans on that committee don't care about the right to their health care either. So someone had to say something."

Slamen said she thought her actions, both from Monday and since the now-famous incident, were indicative of a growing trend.

"Women all over the world are socialized to suppress their dissent, be agreeable, ask for what should rightfully be ours," she said, going on to note that women were finally getting "tired of it," especially in Texas' male-dominated legislature.

Despite the vocal backlash over Texas' anti-abortion bill, lawmakers in the state House have already passed it. The state Senate is expected to follow suit on Friday. Reported by Huffington Post 3 days ago.

Jane Nelson, Texas GOP Senator: Abortion Bill Isn't A 'War On Women!' I'm A Woman!

AUSTIN, Texas -- It's been a long week for Texas state Sen. Jane Nelson.

As Republican chairwoman of the Senate Health and Human Services Committee, Nelson has played a central role in ushering a controversial abortion bill through the legislative process.

She presided over a marathon hearing on Monday that heard public testimony from more than 3,800 people. Some shared gut-wrenching stories about being raped and getting pregnant. Some expressed regrets about abortions they wish they hadn't had. Scores of women fumed about the bill eroding their reproductive rights, with one woman making this point in the form of a poem: "If My Vagina Was A Gun."

Nelson presided over another hearing on Thursday, where pro-abortion rights Texans in the audience burst into song the "We're Not Gonna Take It" by Twisted Sister, and were led out of the room by security as Nelson and other Republican lawmakers voted to send the bill to the Senate floor.

Nelson will be among those voting Friday to pass the bill in the Senate, the last step before it heads to Gov. Rick Perry (R) to become law. Among its provisions, the measure would ban abortions after 20 weeks and require that all abortions -- including those induced by a pill -- be performed in ambulatory surgical centers. It would also shutter nearly all of the state's abortion clinics.

The Huffington Post caught up with Nelson on Thursday and asked if she was worried that the state's fight over abortion rights, which has sparked massive rallies and gotten national attention, could hurt Republicans politically when it comes to female voters, particularly in 2014. She responded with agitation.

"Now I gotta tell you, I am really angry about that phrase 'war on women," she said. "I'm a woman!"

Nelson, who came to the Texas Senate in 1993, touted her record on standing up for women's issues, saying she was "speaking loudly for women's rights" in college 40 years ago.

"My generation laid the groundwork for a lot of these young women," she said. "We were the generation of firsts ... We were the ones that broke into that glass ceiling and we paved the way for years."

She demurred, though, when asked if that meant she thinks the abortion bill helps women's rights.

"No, I'm saying the women's rights issue has been brought into this," she said. "There are many other women's rights issues that we could be talking about. This is not a war on women. This bill is, you know, trying to correct a war on babies that's taking place ... That's not anti-woman. Half of those babies are going to be women."

"This is not a women's rights bill," Nelson added. "It's not going to hurt the Republican Party."

Rep. Jessica Farrar (D-Texas), who leads the House Women's Health Caucus, called it "really puzzling" that Nelson would tout her background on women's rights while dismissing the abortion bill as unrelated.

"I don't know what she calls women's rights, but I think it includes a woman's self-determination," Farrar said. "This bill jeopardizes women's health."

Farrar noted that Nelson's voting record doesn't exactly reflect that of a leader on women's rights. In the last legislative session, Nelson was among those who voted to cut more than $73 million out of the state's $111.5 million family planning budget, which resulted in cutting off 147,000 women and closing more than 50 clinics. She also voted against legislation to bring the state into compliance with the Lilly Ledbetter Fair Pay Act of 2009, a federal law that makes it easier for women to sue employers over wage discrimination.

As for whether Republicans should expect a backlash in 2014 because of the abortion fight, Farrar didn't hesitate with a response: "Definitely."

Texas may be overwhelmingly Republican, but Farrar said Republican women in the state have already shown that they can be swayed to vote for Democrats. She cited Ann Richards, the former Democratic Texas governor, who she said was elected with the support of a substantial number of Republican women.

House and Senate Republicans rallying behind the abortion bill "have made a huge tactical error" for their reelection campaigns, Farrar said. Reported by Huffington Post 3 days ago.
