Texas Republicans Try To Do To LGBTQ Rights What They Did To Abortion Access

WASHINGTON ― Texas lawmakers have a history of finding ways to get around landmark U.S. Supreme Court decisions. They tested Roe v. Wade by dramatically restricting abortion rights in the state, shuttering abortion clinics and forcing women to drive hundreds of miles to reach an abortion provider.

Now that the Supreme Court has ruled in favor of marriage equality, Texas Republicans are trying a similar strategy to chip away at LGBTQ rights. This legislative session, they’ve introduced at least two dozen bills that advocates say target LGBTQ people for discrimination. And what happens in Texas doesn’t always stay in Texas.

“Often, the far-right strategies in Texas are exported to other states,” Kathy Miller, president of the Texas Freedom Network, a progressive activist group, told reporters on Monday. “We’re kind of a testing ground or a petri dish for extremist political strategies.”

That’s a grim forecast for progressives who have watched conservatives rewrite abortion laws across the United States, effectively winning what activists call the “war on women.” The Supreme Court struck down abortion restrictions in Texas last year —but that didn’t stop state lawmakers from introducing dozens of new anti-abortion bills this session.

The wave of anti-LGBTQ legislation also covers a lot of ground. One bill would permit wedding photographers, caterers and DJs to deny services to same-sex couples. Another would allow student clubs at public universities to deny membership to LGBTQ people. Other bills protect faith-based groups that use taxpayer dollars and discriminate against LGBTQ couples when providing foster care services.

The 85th legislative session has “chosen to declare war on transgender Texans,” Lauryn Farris, Alamo regional director for the Transgender Education Network of Texas, told reporters on Monday. “As a result, all of us feel threatened by the very people we elected to protected us.”

Texas Republicans claim their bills are about protecting religious freedom. And in the same way some anti-abortion bills are packaged as a way to protect women’s health, Texas conservatives have cited women’s safety as a reason to push legislation banning transgender people from using some bathrooms that correspond with their gender identity.

“If laws ... allow men to go into a bathroom because of the way they feel, we will not be able to stop sexual predators from taking advantage of that law, like sexual predators take advantage of the internet,” Lt. Gov. Dan Patrick (R) has argued. (CNN surveyed 20 law enforcement agencies in states that had anti-discrimination policies covering gender identity; none of those that replied reported subsequent bathroom assaults.)

The anti-transgender bill that Patrick calls the “women’s privacy act” — and which followed in the footsteps of the “bathroom bill” that sparked political backlash in North Carolina — has been a cause of concern for businesses. The NFL warned earlier this year that such a proposal could influence whether it decides to host future sporting events in Texas. And a study commissioned by Visit San Antonio and the San Antonio Area Tourism Council found that bathroom bills could cost the state $3.3 billion in annual tourism and more than 35,600 full-time jobs.

Another Texas bill introduced in March — which House Republicans hope will be more palatable to corporations — would ban local anti-discrimination protections, including voiding those that already exist. That language could apply to protections for veterans or pregnant women, The Dallas Morning News pointed out.

A revised version laid out before the House Committee on State Affairs last week, which was obtained by HuffPost, specifically bans “political subdivisions,” including public school districts, from enforcing an anti-discrimination ordinance that regulates access to restrooms, showers or changing facilities.

Texas Rep. Ron Simmons (R), who authored the bill, could not immediately be reached to comment on LGBTQ advocates’ concerns. Texas Gov. Greg Abbott has called Simmons’ bill “a thoughtful proposal to make sure our children maintain privacy.”

But opponents of the bill include people like Rachel Gonzales, an activist and mother of a 7-year-old transgender girl. “My daughter has been surrounded by love and acceptance in both her home and school lives,” she told reporters on Monday. But she fears the bill will “remove my daughter’s school’s ability to keep her safe.”

She added, “These extremists are continuing to go after transgender people for political gain. We are tired of it and it is wrong.”

Cathryn Oakley, senior legislative counsel at the Human Rights Campaign, which advocates for LGBTQ rights, added that “none of these bills are actually about bathrooms, they’re all about prejudice.”

Justice Sotomayor Boils Down What's Twisted About The Law On Police Brutality

WASHINGTON ― The Supreme Court doesn’t decide a lot of police shooting cases, but when it does, it tends to side with the officers. And increasingly it does so in unsigned rulings for which it doesn’t bother to hold oral arguments.

The justices again sided with the police Monday, but by choosing to not get involved. They declined to review a ruling from Texas favoring an officer who shot an unarmed man in the back after a vehicle stop. In the officer’s view, the shooting was justified because the driver had appeared to reach for a gun in his waistband.

Except it’s not at all clear that the victim, Ricardo Salazar-Limon, was even reaching for his waistband, let alone that the officer’s version of events is the final word of what happened in the case. A jury never got to weigh the conflicting versions.

Given this uncertainty, Justice Sonia Sotomayor wrote in a pointed dissenting opinion that the Supreme Court should have heard the case — if only to reaffirm the principle that juries, not judges, should be the ultimate arbiters of who’s being truthful when an officer is accused of violating a person’s civil rights.

“The question whether the officer used excessive force in shooting Salazar-Limon thus turns in large part on which man is telling the truth,” Sotomayor wrote in her opinion, joined by Justice Ruth Bader Ginsburg. “Our legal system entrusts this decision to a jury sitting as finder of fact, not a judge reviewing a paper record.”In many ways, the facts of Salazar-Limon v. City of Houston are reminiscent of the countless incidents of police brutality that have grabbed headlines and hashtags since the 2014 fatal shooting of Michael Brown in Ferguson, Missouri.

Back in 2010, Salazar-Limon had been drinking and driving erratically on a Houston freeway when Chris Thompson, a Houston Police Department officer, stopped him at a roadside check. After finding no open warrants or pending charges, Thompson asked Salazar-Limon to step out of his truck, and the two stood next to each other near the back of the vehicle.

This is where the details of their encounter gets a little hazy, and the two sides dispute what happened exactly. But one thing is clear: Salazar-Limon began to walk back to his truck, then Thompson shot him in the back. The victim testified that he was shot “immediately.” But Thompson said he shot Salazar-Limon only after he ordered him to stop walking and perceived that he was reaching for a firearm in his waistband.

Rather than acknowledge this conflicting testimony and let the case be decided by a jury, two lower courts determined that Thompson’s version of the shooting ruled the day and that he shouldn’t be held liable.

Perhaps drawing on her years as a trial judge, Sotomayor observed that “the evenhanded administration of justice does not permit such a shortcut.”

“Our failure to correct the error made by the courts below leaves in place a judgment that accepts the word of one party over the word of another,” wrote Sotomayor, who has become one of the fiercest critics of how the law shields police abuse.

In a footnote, Sotomayor added that the “increasing frequency” of police officers shooting unarmed suspects going for “empty waistbands” makes it all the more imperative for jurors to be the ones deciding who’s more credible in these kinds of cases.

More tellingly, the justice then expressed dismay at a “disturbing trend” in how the Supreme Court has played a role in jumping to immunize police officers who are quick to pull the trigger, while doing little to step in whenever an officer has been wrongly shielded.

“But we rarely intervene where courts wrongly afford officers the benefit of qualified immunity in these same cases,” she wrote, as she listed case after case after case in which her colleagues instead gave officers a reprieve from liability. She called that feature an “asymmetry” that the court, at times, has tried to correct.

“We take one step back today,” Sotomayor wrote.

Justice Samuel Alito wrote a short response to Sotomayor, in which he stood up for the courts that ruled for Officer Thompson — and for the Supreme Court’s handling of similar cases.

“This is undeniably a tragic case, but as the dissent notes ... we have no way of determining what actually happened in Houston on the night when Salazar-Limon was shot,” Alito wrote. “All that the lower courts and this Court can do is to apply the governing rules in a neutral fashion.”

Congress Is Its Own Obstacle In Russia Probe Watch VideoThe Senate probe into Russia's involvement in the 2016 election and allegations of collusion with the Trump campaign hasn't made much progress.

Recent reporting from The Daily Beast and Yahoo News paint the Senate Intelligence Committee's investigation as dysfunctional, to say the least. 

After more than three months, there's not a single full-time staffer dedicated to the investigation. The Daily Beast reports seven part-time staffers, none with legal or investigative experience, are working on the probe.

The panel has asked key players in the Trump campaign to preserve some of their documents for review — but it hasn't actually subpoenaed those documents or requested interviews with those players.

According to Yahoo, that's partly because the panel's top Republican, Sen. Richard Burr, hasn't signed letters requesting that those documents be turned over. The outlet says his Democratic co-chair, Sen. Mark Warner, is hesitant to pressure Burr to get things moving because he wants to preserve a bipartisan image — something that's frustrated several Democrats.

What it has done is review documents and interview intelligence analysts who contributed to the assessment on Russia's involvement in the election. 

The committee's counterpart in the House hasn't been running so smoothly, either.

Republican chair Devin Nunes caught himself up in a scandal after he tried to defend the president's wiretapping claims with information obtained covertly from the White House.

Nunes, along with Attorney General Jeff Sessions, have now both recused themselves from the investigation. Nunes is also under an ethics investigation for the incident.

Nunes was replaced by Rep. Mike Conaway, a Texas Republican who has gone to great lengths to defend the president.

Despite that, the House intelligence committee is getting back on track. Along with rescheduling a public hearing with former Deputy Attorney General Sally Yates, the panel has scheduled a closed hearing with FBI Director James Comey and NSA Director Adm. Mike Rogers on May 2. 

The first public hearing the committee held with the two intelligence chiefs featured Comey confirming the FBI's investigation into Russia's possible interference as well as potential ties to the Trump campaign. Reported by Newsy 53 minutes ago.

· 2016’s upward trend for ACH transactions also has carried over into 2017. With more than 5 billion transactions, first quarter ACH volume has increased by nearly 7 percent over the same quarter last year.

· As overall ACH volume continues to grow, so does the adoption and implementation of Same Day ACH. This faster payment solution saw more than 13 million payments totaling more than $17 billion in the first quarter of 2017 . These numbers represent a 13.6 percent increase from the fourth quarter of 2016.

The ability to provide faster payments and enhance the customer service experience contributed in large part to the successful launch of Same Day ACH for credits and is just one of the reasons NACHA is excited about the potential of Same Day ACH for debits, which will be introduced in September.

The Hershey Company has announced that it will be rolling out special editions of their most popular candy — Kit Kat, Reese's, Hershey's Kisses, and PayDay just to name a few — nationally under the theme "Taste of America."

The collection of candy has new flavors "inspired by the unique tastes of iconic, U.S. summer destinations," states the official press release.

In a bid to fend off criticism over a dearth of achievements in his first 100 days in office, President Trump plans to sign a flurry of executive orders this week.

Among them is an executive order intended to* open up new areas of offshore oil and gas drilling.* "This builds on previous executive actions that have cleared the way for job-creating pipelines, innovations in energy production, and reduced unnecessary burden on energy producers," a White House official told the Reuters earlier this week.

*The order calls for a “review of the locations available for offshore oil and gas exploration and of certain regulations governing offshore oil and gas exploration.”*

Specifically, the Trump administration is hoping to open up new areas to drill in the Gulf of Mexico, plus areas in the Atlantic and Arctic Oceans. The Obama administration had previously designated the Atlantic and the Arctic off limits, and did so in such a way as to make it legally very difficult for subsequent administration’s to reverse.

*The road to new drilling in the Arctic and Atlantic Oceans will be long and bumpy, for several reasons.* First, any attempt to open up the Arctic and Atlantic Oceans will be met with tough litigation. The President’s authority to reverse the Obama administration’s move is debatable. Second, the Interior Department will have to include tracts of drilling in its Five-Year plan, and putting acreage into the plan requires extensive environmental analysis that could span several years, especially for the Atlantic Ocean, where no drilling has taken place yet.

On top of that, even if the administration succeeds in leasing offshore acreage – which will be years from now at the earliest – *who will be interested? *Royal Dutch Shell already had a crack at the Arctic, spending $8 billion and almost a decade of work with nothing to show for it. In 2015, after completing one well in the Chukchi Sea with disappointing results, Shell abandoned the Arctic and wrote down its assets. Shell’s Arctic program came to a halt because of low oil prices and poor prospects in the Chukchi – President Obama shut down the Arctic only after Shell had given up on it. It was a colossal failure for a region that has routinely been hyped as the next big thing in oil exploration.

*A greenlight from Trump won’t change the poor economics of Arctic drilling. *Although precise breakeven costs are difficult to pin down, particularly since no oil has been produced in the Chukchi Sea, it is generally assumed that oil prices need to trade over $100 per barrel. Hardly anybody expects oil prices to return to triple digit territory anytime soon, so even if the Trump administration somehow manages to open up the Arctic again, there will be very few companies willing to roll the dice on the Arctic. It is better to spend money on U.S. shale.

The Atlantic could be different. The extent of the resource base is unknown, given the lack of exploration to date. *There could be a lot of oil on the U.S. eastern seaboard, or not very much at all. *The best guess comes from a 2011 assessment by the Bureau of Ocean Energy Management, which put the mean estimate of total oil reserves in the U.S. Atlantic at just 3 billion barrels – which is a small fraction of the 48 billion barrels in the Gulf of Mexico and the 26 billion barrels thought to be off the coast of Alaska. And that volume could turn out to be even lower.

More importantly, as an area new to exploration, production costs will be higher. *At $50 per barrel, it is not at all clear that there is an economic case for Atlantic drilling.* Compared to the Arctic, the Atlantic does have the virtue of having more hospitable conditions as well as proximity to existing infrastructure, such as pipelines and refineries. Nevertheless, even if Trump succeeds in opening up the Atlantic, it will take years before any acreage is listed for a lease sale, followed by many more years of seismic testing and exploration. Production is far off into the future. And that assumes companies are even interested. * Related: Did OPEC Shoot Itself In The Foot?*

Separately, President Trump signed an executive order on Wednesday that asks the Interior Department to review previous national monuments designations under the Antiquities Act, which allows the President to protect certain public lands. *White House officials have said that “past administrations have overused this power and designated large swaths of land well beyond the areas in need of protection.”*

The move comes after President Obama designated Bears Ears a national monument, a scenic area in Utah that is sacred area to Native communities that drew the interest of oil and gas drillers. The designation at the eleventh hour of the Obama presidency put Bears Ears off limits to the oil and gas industry, angering politicians from Utah. Texas shale company EOG Resources had received a permit to drill in the area. President Trump’s executive order this week is clearly an attempt to roll back that designation.

But just as with offshore drilling, the move to rescind public lands protections will also likely face legal challenges and faces an uncertain future.
