According to Fox 14 (“Driver in deadly hit-and-run crash arrested,” October 31; case number 2013-PFILEO5272, El Paso District Court), a driver suspected to have fled the scene of an accident after crashing into a motorcycle was arrested and faces charges that reflect the change in Texas state law that increases penalties for hit-and-run drivers involved in fatal accidents.

“This tragic accident is a warning to all drivers that no matter their reason for fleeing the scene; it’s an illegal act that carries serious penalties under Texas law. As of September 1, the penalty for hit-and-run related fatalities are equal to that for intoxicated manslaughter and under Senate Bill 275 is considered a second degree felony,” said Gopin, who represents victims of negligence and families who lost loved ones in accidents.

Fox 14 reported that the late September accident occurred after an SUV drove into the path of a motorcycle that was driving south on the 9100 block of Dyer Street before fleeing the scene of the accident. The driver of the motorcycle struck the vehicle’s right side and was pronounced dead at the hospital, according to Fox 14.

The alleged hit-and-run driver involved in the accident was found and arrested in late October, Fox 14 said. The suspect faces an “accident involving death” charge, which reflects recent changes in Texas hit-and-run legislation.

“Fleeing the scene of an accident is a crime in El Paso and throughout the state of Texas. That’s regardless of who’s at fault or why. Law enforcement officials are well-aware of this fact, and when found, hit-and-run drivers will face prosecution,” said Gopin, a hit-and-run car accident attorney in El Paso.
