Texas Car Accident Attorney Wins 2 Jury Trials against Allstate

A Texas car accident attorney with Schechter, McElwee, Shaffer & Harris recently returned successful jury verdicts in two auto accident cases against Allstate Insurance.

In the first claim, case number 2011-08757 in the 133rd District Court in Harris County, Texas auto accident lawyer A.J. Rosenfeld's clients were traveling on Interstate 10 near Columbus, Texas, according to court documents. The husband and wife were rear-ended by another driver, and the impact caused their vehicle to strike the center median and end up in a ditch.

The at-fault driver was insured, but their liability limits were inadequate to compensate for the damages, according to court documents.

“My clients made claims on their own Allstate Underinsured Motorist contract to provide for their injuries and losses sustained in an accident where the responsible parties are underinsured,” Rosenfeld said.

Allstate Insurance offered each client a settlement of $27,500, court records show.

“We believed Allstate unreasonably and in bad faith refused to investigate the claims and enter a fair settlement,” Rosenfeld said. “We were forced to take the claim to trial to obtain an equitable judgment for my clients’ damages.”

The jury awarded the wife $50,868.50 and the husband $37,960.

In the second trial, case number 2012-44722 in the 80th District Court in Harris County, court documents show Rosenfeld’s client was rear-ended on Highway 146 in Baytown, Texas. Allstate, the at-fault driver’s insurer, offered a settlement of about $5,000.

According to court documents, the other driver said Rosenfeld's client swerved in front of the at-fault driver.

“We explained to the jury that the at-fault driver was negligent for not maintaining a proper speed and inattentive driving,” Rosenfeld said.

The jury awarded Rosenfeld’s client $10,000.
