Experts say the U.S. Supreme Court’s upholding of the individual mandate will benefit biomedical research. Since the Affordable Care Act just went into effect in January 2014, researchers will now see the benefits of the mandate upheld by the U.S. Supreme Court.

The U.S. Supreme Court upheld the ACA’s individual mandate by a vote of 5-4 on June 28, 2012. The ACA contains provisions that will establish a pathway for the Food and Drug Administration to approve generic version of protein-based drugs, often referred to as biosimilars. The ACA also creates a research initiative at the National Institutes of Health called the Cures Acceleration Network, the launch of the Physician Payment Sunshine Act, and a push to increase funding for comparative effectiveness research. The Physician Payment Sunshine Act would require pharmaceutical and device makers to disclose all payments of more than $10 made to doctors.
“With this ruling, what we have is the turning of a page and a new chapter,” said Mary Wooley, CEO of science advocacy group Research!America. “It is time to be talking about research and innovation as a major driver in health care.”
