The Law Offices of Stipe & Belote Obtains Compensation for Car Accident Victim Through Verdict

Attorney James Belote from the Law Offices of Stipe & Belote successfully secured compensation for a car accident victim who was hurt after another driver failed to stop at a stop sign. The compensation was awarded through a trial verdict.

A car accident victim who was represented by Oklahoma City Personal Injury Attorney James Belote in trial obtained a court judgment for $752,458.31 in compensation for her injuries, according to journal entry of judgment filed on April 10, 2014 (Cox v. Blakely and Southwestern Bell Telephone Company, Case No. CJ-11-145 in the District Court within and for Seminole County, Oklahoma). According to the court records, the plaintiff received a judgment of $752,458.31, which is three times higher than the best settlement offer made by the defendants.

Court documents show that the case stems from an auto collision that occurred in an intersection on Dec. 29, 2010. The plaintiff alleged that the defendant’s driver failed to stop at a stop sign and pulled in front of the plaintiff’s vehicle, which is said to have caused the accident. The defendants, in turn, claimed that the stop sign was defective and was not visible, according to court records, and they blamed the City of Wewoka for failing to properly maintain the sign. The defendants also alleged that the plaintiff was driving twice the legal speed limit.

According to the journal entry of judgment, the verdict was reached on November 19, 2013. The jury ultimately decided that the defendants were 80% at fault, the City of Wewoka was 10% at fault and the plaintiff was 10% at fault. Due to this determination, court records state that the $836,000 verdict was reduced by 10% to $752,400 to reflect the plaintiff’s contributory negligence. However, the compensation amount was raised to a total judgment of $752,458.31 due to the addition of pre-judgment interest. The plaintiff is also entitled to post-judgment interest.
