A new Pretrial Report has been issued in the federal DePuy Pinnacle hip replacement (http://www.depuypinnacle-lawsuit.com/depuy-pinnacle-hip-implant/) litigation that indicates the proceeding’s first two bellwether cases will be ready for trial on September 1st, Bernstein Liebhard LLP reports. According to the July 29th report, with a few limited exceptions, discovery in the cases is complete and the Court has ruled on all outstanding motions. Among other things, the report also lists all witnesses that the parties might call during the trial. Court records indicate that more than 6,400 Pinnacle hip lawsuits are now pending in the litigation underway in the Northern District of Texas. All of the lawsuits claim that the metal-on-metal version of the Pinnacle hip replacement can shed dangerous amounts of toxic metal ions into the surrounding tissue and blood stream. According to court documents, the cases scheduled for trial in September were filed on behalf of two Montana residents who underwent hip revision surgery after allegedly experiencing DePuy Pinnacle complications that included severe pain, metallosis, and elevated blood serum levels of chromium and cobalt.
In January 2012, the U.S. Food & Drug Administration (FDA) warned that metal-on-metal hips like the device at the center of the DePuy Pinnacle litigation were more likely to fail early than those made of other materials. The agency also revealed that it was considering new rules that would subject the all-metal hips to greater regulatory oversight.
In May 2013, Johnson & Johnson and DePuy Orthopaedics announced that they would cease the sale of metal-on-metal hip implants, including the device involved in Pinnacle hip lawsuits.*
